Cancellation Policy

1. Project Cancellation

Clients may cancel projects at any time by providing written notice via email to info@novadesignforge.pro. Cancellation terms depend on the project phase and work completed at the time of cancellation notice.

We also reserve the right to cancel projects under certain circumstances as outlined in section 3 below.

2. Refund Policy

Refunds are calculated based on work completed at the time of cancellation:

  • Before work begins (0% complete): Full refund minus 10% processing fee
  • Initial phase (1-25% complete): 75% refund of total project cost
  • Development phase (26-50% complete): 50% refund of total project cost
  • Advanced phase (51-75% complete): 25% refund of total project cost
  • Near completion (76%+ complete): No refund available

Project completion percentage is determined by NOVADESIGNFORGE based on milestones achieved, time invested, and deliverables completed. This assessment will be provided to the client upon cancellation request.

3. Our Right to Cancel

We reserve the right to cancel projects and terminate agreements if:

  • Payment terms are not met after reasonable notice and grace period
  • Client requests consistently fall outside agreed project scope
  • Professional conduct standards are not maintained by the client
  • Client fails to provide necessary materials or feedback within reasonable timeframes
  • Project requirements become technically infeasible or legally problematic

In such cases, we will provide written notice and opportunity to remedy the situation before proceeding with cancellation.

4. Deliverable Ownership

Upon cancellation, clients receive all completed work files and deliverables for which full payment has been made. This includes:

  • Completed design files in agreed formats
  • Source files for finished components
  • Documentation for completed work
  • Access credentials for completed setups

Incomplete work, work-in-progress files, and intellectual property for unfinished components remain the property of NOVADESIGNFORGE unless specifically agreed otherwise.

5. Processing Time and Method

Refunds, when applicable, will be processed within 5-10 business days of cancellation confirmation and final invoice settlement. Refunds will be issued to the original payment method used for the project.

Bank transfer fees or payment processing charges may be deducted from refund amounts. International transfers may take additional time and incur currency conversion fees.

6. Outstanding Work and Deliverables

Before processing any refund, the following must be completed:

  • Final project assessment and documentation
  • Delivery of all completed work and files
  • Transfer of relevant access credentials and accounts
  • Settlement of any outstanding expenses or third-party costs
  • Return of any proprietary materials or confidential information

7. Third-Party Services and Expenses

Costs for third-party services (hosting, domains, licenses, stock photos, etc.) purchased specifically for the project are non-refundable and will be transferred to the client or deducted from any refund amount.

Clients are responsible for managing these services independently after project cancellation.

8. Cancellation During Rush or Priority Work

Projects marked as rush, priority, or expedited may have different cancellation terms due to resource allocation and scheduling impacts. These terms will be clearly specified in the project agreement.

9. Force Majeure

In cases where project cancellation is due to circumstances beyond either party's control (natural disasters, pandemics, legal changes, etc.), refund amounts will be calculated fairly based on work completed and costs incurred.

10. Dispute Resolution

Any disputes regarding cancellations or refunds will first be addressed through direct communication between parties. If resolution cannot be reached, disputes will be handled according to the terms outlined in our Terms of Service.
